People are charged all the time for shooting someone when they thought a gun was empty. Its not an excuse. No matter who handed it to them.
Here are just a couple examples of police officers who thought they had empty weapons during training and they were even charged. In the end its the person holding the guns responsibility to ensure the weapon is indeed safe. In the end I dont think he will do jail time, but he will plea down to a lesser charge and get probation. He is not getting off scott free.
