What is the big deal? They're the good guy corporation right? They're using that to protect us from terrorists in COD multiplayer.

Not that this is a surprise to anyone, but Sony can monitor your voice communication and will do so. What separates this from others from the past is that they're not saying it's because of law enforcement. They're doing it for their own reasons. I'm not to sure how well that will sit with some people. With the uproar people made about the Xbox One sending pictures of your randomly to their servers, which was proven false, how will the masses react to this? Will people be OK with Sony listening to your conversations at their choosing for their own reasons and not because of law enforcement forcing? via Polygon and Sony (full ToS).

14. Are we monitoring PSN?14.1. Yes but we can't monitor all PSN activity and we make no commitment to do so. However, we reserve the right in our sole discretion to monitor and record any or all of your PSN activity and to remove any of your UGM at our sole discretion, without further notice to you. Your use of PSN and our community features may be recorded and collected by us or sent to us by other users as described in 13.1. Any information collected in this way, for example, your UGM, the content of your voice and text communications, video of your gameplay, the time and location of your activities, and your name, your PSN Online ID and IP address, may be used by us or our affiliated companies to enforce these Terms and the SEN Terms of Service, to comply with the law, to protect our rights and those of our licensors and users, and to protect the personal safety of our employees and users. This information may be passed to the police or other appropriate authorities. By accepting these Software Usage Terms, you expressly consent to this.

Who doesn't think ALL of these companies aren't watching/monitoring what we do!?
At least we aren't forced to use a camera.....oops! that's right that was one of MS's 180's :p

Yeah, none of this matters if it can't be used to bash Microsoft. Like Shultzy, they'll disregard it or flat out refuse to believe. The truth is, though, both consoles are listening devices the Man can turn on any time he wants to.

With all the exciting news coming out today about the PS4, it figure this would be the thread that gains traction on this site. Pathetic.

You're gonna pull this card after all of the nonsense people posted about Kinect and spying? This came out today with Sony updating their ToS.

Yeah, it's quite lame to be honest. Show me where it says I will be monitored for ad tailoring or where Sony has signed on with PRISM and then I will care. This is just like every other TOS of every other online service. There is a pretty big PS event going on right now, where is that news?

I'm not at the show. The show is happening now. What would you like me to report? You have thread making ability right?

And anybody that claims this is not a big deal but called MS on it is a hypocrite.

Mandatory kinect + mandatory 24 hour DRM checkins had far more privacy implications than PS4 ever did. False equivalence to compare the two things.

Yes, remember, kinect had to be plugged in or the system wouldn't function? How quickly we forget.

hmm actually the terms are new

The previous version of the document published in July did not include the newly introduced terms. A more generalized version of the Software Usage Terms which covers all PlayStation devices, has been published to the UK PlayStation website.

It is worth noting that an older, abridged version of those terms on the UK site already included a clause preventing the reselling of games for the PS3, but the newer terms have now expanded this to encompass the PS4 too, apparently contradicting Sony's claims that it would not prevent users from selling their games on after use. We have contacted Sony to request clarification and will update this article if and when we hear back from them.

Gamers who had been upset with Microsoft's DRM policies voiced support for Sony's PlayStation 4 after the E3 announcement which led to Microsoft reversing on some of their policies.

Update: Sony has responded to our request for comment with this statement:
As SCE announced at E3, consumers will be able to sell or share their PS4 disc products."
Unfortunately, while this statement will reassure PS4 buyers who may want to sell their "disc products" further down the line, it does nothing to clarify the changes that Sony made to its terms of service, which introduced new clauses forbidding certain actions - including the sale of "disc-based software" - nor does it address how these changes will actually affect users.

frankly I personally thought Sony was planning on the same practices as Microsoft, but changed when they saw the reaction to Microsoft
but this is my opinion

this is just an fyi for those that Sony is the greatest on earth
and Microsoft is evil.. sonys past is really not good
which is why I always hesitated to buy their products
but I do own a ps3, will eventually get a ps4

Sony BMG copy protection rootkit scandal
From Wikipedia, the free encyclopedia

The Sony BMG CD copy protection rootkit scandal of 2005–2007 concerns copy protection measures implemented by Sony BMG on about 22 million CDs. When inserted into a computer, the CDs installed one of two pieces of software which provided a form of digital rights management (DRM) by modifying the operating system to interfere with CD copying. Both programs could not be easily uninstalled, and they unintentionally created vulnerabilities that were exploited by unrelated malware.

One of the programs installed even if the user refused its EULA, and it "phoned home" with reports on the user's private listening habits; the other was not mentioned in the EULA at all, contained code from several pieces of open-source software in an apparent infringement of copyright, and configured the operating system to hide the software's existence, leading to both programs being characterized as rootkits.
Sony BMG initially denied that the rootkits were harmful. It then released, for one of the programs, an "uninstaller" that only un-hid the program, installed additional software which could not be easily removed, collected an email address from the user, and introduced further security vulnerabilities.
Following public scorn, government investigations and class-action lawsuits in 2005 and 2006, Sony BMG partially addressed the scandal with consumer settlements, a recall of about 10% of the affected CDs, and the suspension of CD copy protection efforts in early 2007.

their answer to this?
Thomas Hesse, Sony BMG's Global Digital Business President, told reporter Neda Ulaby, "Most people, I think, don't even know what a rootkit is, so why should they care about it?"

sony was sued among other things
it was a DRM issue among other things, and this was only one of the scandals

so please.. remember
neither company is the bad guy, nor the good guy
and at least Microsoft was open about it
and do not assume that sony is doing this for the gamers

How quickly we conveniently forget that all of Kinect's features will be able to be turned off. That was a common theme for people looking to attack MS and the Xbox One. People seem to always ignore that you were able to turn everything off. And having to check in your console has absolutely nothing to do with privacy concerns.

Sony repeats its PS4 used game message
November 12, 2013

In the wake of reports suggesting that new clauses in Sony's terms and conditions have seen the company backtracking on its previous PlayStation 4 used game message, Sony Worldwide Studios president Shuhei Yoshida has reiterated the original policy.

The company previously said that there will be "no restrictions" on preowned games, meaning that PS4 owners can sell or trade in their purchased retail games after use.

However, an alteration to Sony's Software Usage Terms for the UK this week states, "You must not resell either Disc-based Software or Software Downloads, unless expressly authorised by us and, if the publisher is another company, additionally by the publisher."

Yoshida has now clarified that the clause is just a legality, and nothing about the company's policy that it revealed at E3 earlier this year has changed.

"That's the terms of service on the European side of PSN," he told Gamasutra. "We have no DRM, no new DRM at all. It's just a legal thing. People can sell PS4 disc games like we've been saying publicly... Legal people come up with these things."

A Sony spokesperson also reiterated to Gamasutra, "As SCE announced at E3, consumers will be able to sell or share their PS4 disc products."

Rrrrrrrrrrrrrruuuuuuuuuuuuunnnnnnnnn!

Oh wait its not MS so the net doesn't care.

Yes, the legal people come up with these things all the time because when you click accept it is binding which means that Sony and others can go after you when selling you disc based games. What an idiotic statement from them.

Just because I am holding a gun at you that is cocked and ready to fire with my finger on the trigger does not mean I have any intention of harming or threatening you. Yes, you shouldn't have even known I had the gun so this might be a problem...

Yup they're doomed. They'll go after pirates that rip the code off the disks, and distibute the game on the internet.
Shame on Sony for keeping people from sharing their games!

lol at the hypocrisy in this thread.. You could cut it with a butter knife!

Sorry Sony guy's I hate to be the bearer of bad news, but it turns out that Sony is in fact not perfect.
