Nintendo announced on its official website that games from the Nintendo 64 console will soon be available on the Wii U Virtual Console.
There has previously been a long silence on when Nintendo will be offering Nintendo 64 games on the Wii U Virtual Console, which previously only showcased games from the Nintendo Entertainment System (NES) and Super Nintendo Entertainment System (SNES) consoles.

As long as they are cheap and HD. I'm still intimidated by the Wii U's digital games policies.

They don't fare well today... hopefully they improve/remove the blurry textures.

Compared to plugging an N64 into an HDTV they sure do. Not sure about my TV now but my old TV wouldn't even display color on my SNES and N64. The virtual console is amazing in every way. It's made older games at least playable on newer TVs.

Are Nintendo free to put up all of Rare's games? Rare own several of the IPs.

I believe that Nintendo can put up any of the games that Rare made featuring their own intellectual property. Diddy Kong Racing, Donkey Kong 64, etc.

They cannot, without negotiating with Rare and MS, put up any other franchises in the Rare catalog. Jet Force, Perfect Dark, Battletoads, etc.

Semi back from some resting period, still I find it too hot to sit in front of a computer screen for extended amounts of time. In any case:

I wish they would just allow some kind of pay per month scheme to allow me all the Virtual console games to be played on my Wii U. Even if it was set per generation/console. Like all NES titles 10 bucks a month (if you no longer pay for them the titles are forfeit). I just have so many NES games I wish to play again legally that it would become a very expensive endeavour. I might as well buy them second hand and fire up my old NES :).

Same goes for the N64, I want to give Nintendo my money, I just think the prices are a bit too steep for the older games.

After reading up on it, it appears:

Rare games featuring Nintendo IP, Nintendo retains ownership of their characters. (Diddy, Donkey, Starfox)

Rare retains ownership of the additional characters.

Rare's IP is owned by MS.

MS would have to cooperate with Nintendo for Nintendo to re-release something like Diddy Kong Racing. As Rare/Microsoft own all the characters other than Diddy.

Nintendo might be able to do Donkey Kong 64, since I believe that only has Nintendo characters in it.
